MovingPro CRM & Mobile APP Terms of Service

1. Agreement to Terms
By accessing or using [Pentacles Inc] (“Company,” “we,” “us,” or “our”) software, website, or related services (collectively, the “Services”), you (“Customer,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Services.

2. Subscription & Billing
• Subscriptions are provided on a month-to-month basis unless otherwise stated in a separate written agreement.
• Your subscription will automatically renew each month unless you cancel through your account settings or by written notice prior to the next billing cycle.
• Fees are non-refundable except as required by law.

3. Account Responsibilities
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity under your account.
• You agree to comply with all applicable laws and regulations related to your use of the Services.

4. Data Retention & Deletion Policy
• Upon cancellation or termination of your subscription, your account will be deactivated immediately.
• We will retain your data for a period of [90] days (“Retention Period”) from the effective date of cancellation.
• After the Retention Period, all account data will be permanently deleted from our active systems and backups.
• It is your responsibility to export and retain any legally required documents (e.g., FMCSA compliance records, bills of lading, contracts, etc.) prior to the end of the Retention Period.
• Once data is permanently deleted, it cannot be recovered.

5. Intellectual Property
• All intellectual property rights in the Services remain with the Company.
• You retain ownership of all data you upload but grant us the right to process and store it as needed to provide the Services.

6. Service Modifications & Availability
We reserve the right to modify, suspend, or discontinue the Services at any time with reasonable notice. We will not be liable for any modification, suspension, or discontinuance.

7. Termination
We may suspend or terminate your account if you violate these Terms. You may terminate at any time by canceling your subscription. Termination does not relieve you of any payment obligations incurred prior to termination.

8. Disclaimer of Warranties
The Services are provided “as is” and “as available” without any warranties, express or implied.

9. Limitation of Liability
To the maximum extent permitted by law, our total liability for any claim related to these Terms or the Services will not exceed the amount paid by you in the preceding three (3) months.

10. Governing Law
These Terms will be governed by and construed in accordance with the laws of [New York], without regard to conflict of law principles.

11. Changes to These Terms of Service
We reserve the right to update these Terms of Service from time to time. We will notify you of any changes by posting the new Terms of Service on this page. You are advised to review these Terms of Service periodically for any changes.
